I would like to bring up a claim for a road traffic accident but the incident happened almost 2 years ago, I was hit and knocked off my bike by a passenger opening a passy car door.
I was coming up alongside the car from behind but they should have seen me in the rear view and wing mirrors and legally the driver should have checked the roads before allowing the passenger out anyway, the door quickly swung wide open fast and I did not have time to react, I tried to turn and swerve the obstacle but I had no chance, my bicycle was clipped by the door and I was thrown clean over my handle bars and fell and landed on my head and shoulder and needed an ambulance to take me to hospital.
I had a concussion, was really shaken up and had a fractured and dislocated shoulder, were it not for wearing my helmet I would have been dead or severely brain damaged, the driver and his friend got out to help me and admitted it was their fault and I missed a lot of work recovering from my injuries, how much compensation could I claim for an accident like this, the whole incident is recorded on video through my go pro camera.
I am already in contact with the car owners insurance but what if they do not offer me a settlement though, or offer very little? Do I need to initiate a court case?
