Can I claim back wages as loss of earnings if I am injured in a trip and fall accident at work?

Hi, I had an a trip and fall accident at work at my previous place of employment and have severely injured my back.

i have all the evidence of going back and forth to the doctors and I have various members off staff that still work there as witnesses and my sister came into my work to take me straight to hospital.

the work place told me to stay off as I was bed bound, the did not ask for a doctors note.

I used to work in a discount clothing shop as sales assistant but I am out of work since I tripped on some clothing stock on the floor and fell over and injured my back.

I am back and forth to the doctors in which I have just had an X-ray and I am going to back triage, the doctor has told me I have slipped discs and may have nerve damage as a result.

So far I have been on statutory sick pay but I don't think I will be able to go back to work for a long time and would like to claim ages as loss of earnings.

Can I claim back wages as loss of earnings if I am injured in a trip and fall accident at work?

I am pleased to advise that based on the circumstances you have described, it is our opinion that you are entitled to make a claim for compensation against your employer, so long as your claim is still within the limitation period allowed to bring a claim.

A limitation period means that there is a set period of time by which a Claimant (you) should have “brought” their claim to a court. In a personal injury claim such as yours, you have 3 years to bring the claim to Court, however, if you were legally classed as a minor on the day of incident (under the age of 18) then you have 3 years from the date of your 18th birthday.

In addition, and to answer you other question, yes, you are entitled to claim for any loss of earnings you suffered as a result of the incident.
