Can I claim compensation for a severe back injury in a RTA if the other driver wont admit liability?

Hi just doing some legal search and see if a can claim for compensation for a whiplash injury I got in a road traffic accident.

I was in a car crash that was not my fault, the other driver went into the back of my car and rear ended me, I got out and we swapped insurance details and I got their licence and registration plate number but the driver would not admit liability, claiming the brakes were not responding and they couldn't control the car, will this affect me eligibility to make a claim?

It was a week ago in my car accident my back got hurt now my legs and arms is starting to feel agonising pain as well and still my arm got hurt and it is still have the bruises.

The doctor said I have whiplash in A&E and gave me a 3 week prognosis and said I also may have slipped discs, which has caused nerve damage leading to the loss of sensation and pins and needle pains in my arms and legs.

Can I claim compensation for a severe back injury in a RTA if the other driver wont admit liability?
