Can I make a claim as a passenger?

Hi

I'm hoping you can help me.

I've just been in a taxi and the driver caused an accident. He was speeding around a bend and had to swerve to get out of the way of another car. He ended up crashing into a post box. My neck is really sore and I'm a bit stressed. I want to know if I can make a claim against him as a passenger?

Any info you can give me would be great.

I'm so sorry to hear about the accident. If you haven't already done so, I'd recommend that you get your injuries checked out. A sore neck might not seem much but without a physician checking it over, you can't be sure that more serious damage hasn't been done.

It's tough to see a doctor with the coronavirus at the moment, but I'm sure there's a walk-in centre close by to you.

To answer your question, yes you can make a claim as a passenger. There are two circumstances in which you can claim as a passenger, and you fall into one of them:

• If the driver of the vehicle you were in caused the accident, you could make a claim against their insurance.
• Or if the driver of another vehicle caused a crash involving the vehicle you were in, you can also make a claim but against that driver's insurance.
