I would like to know if we are entitled to claim compensation for personal injuries from a road traffic accident that was 50/50 fault of other driver.
My partner was knocked off his motorbike with two broken ribs.
He was only going at approx 10 miles per hour or less when a car hit him pulling out of a drive way.
The other driver was going much faster and could have killed him and his insurers have said it should be 50/50 fault, really he should have paid more attention for motorcyclist safety.
Either way he has been told by the doctors he has severely broken ribs and may have a punctured lung with fluid on his chest causing a cough.
He has been out of work for a week and has received no sick pay because the other driver has not admitted liability, will he be able to claim back money for loss of earnings?
Can you take a claim on like this when the insurance company has said he has no merit to his case?
If we make a claim and lose the case in court will we be liable for any costs or legal fees or can we get a no win no fee solicitor to help us?
