I'm just curious about whether to claim, I have had an accident in the work place, I was hurt and put out of work for a few days.
I work as a security guard on abuilding site over night, when the site is closed it is my responsibility to go around and close gates around a centre, a vehicle had previously hit the gate, so it was broken but we were still expected to force it shut even though it was jammed where there was normally a space between the gates where the lock and chain go.
The gate is very heavy and hard to control in the wind, it swung in the wind and I couldn't stop the momentum slamming the gates together and I trapped my finger and one more I injured my shoulder while trying to desperately open it.
I was sent home by the manager and I have been off work for a few days and since then the gate got fixed, they must have known they were liable and its a guilty move on the managements side of things.
The incident was recorded in the accident book and I have been to hospital with my conditions and the doctor will have made a medical report.
The doctor told me I had crushed my finger and prognosis it would take months to recover and may never be the same again and the muscle in my shoulder was torn and will take another couple of weeks to heal.
Can I claim compensation for a broken finger, injured shoulder and loss of earnings from my employer?
