How many personal injury claims go to court?

Hi

I was wondering if you can tell me how many personal injury claims go to court on average? I'm thinking of making a claim after slipping over in my local supermarket but I'm not too keen on having to go to court.

It's a good question you ask. Very few personal injury cases make it to court. In fact, it's as low as around 5%. Meaning you have a 95% chance of not going to court. The odds are therefore heavily in your favour.

The vast majority of claims are settled outside of court. Some are abandoned due to lack of evidence or may have been successfully defended.

Claims that make it to court are generally the most contentious of cases, where there is one or more disputed issue. It may see expert witnesses called to give evidence, as well as witnesses to the accident. This all costs a lot of money, so defendants are often keen to settle a case to avoid the risk of paying those costs.
