Passenger in taxi accident was drivers fault, can I claim compensation for whiplash?

I was in a road traffic accident that was not my fault.
I was with my 3 young children going to the shops and getting a private hire car into town, we were in the taxi cab only a short time when we crashed and ive been badly injured with Back pain, neck pain, spells of dizziness and headaches.

It seems to have gotten worse over the past few days. Ive found doing the simple tasks like sitting on the floor with my kids it hurts and its making it hard to cope with day to day tasks and life.

My children are alright, just a little shook up by the incident, but the crash in the taxi right into a fence was not explained by the driver who was clearly liable for driving carelessly.
I have a photo of back of the car and the damages to the fence as evidence of the severity of the crash and I took his insurance but I dont really want to get him fired or in legal trouble with the police so how would I go about just claiming off my injuries?
