Trying to decide whether to claim for a accident at work, a container door hit me and i badly hurt my ribs, i got hit by a container door in the wind and i was off for over a month and as my boss was ringing and asking when i was coming back I was worried about loosing my job and getting laid off, so I went back a week early as he was pressuring me to go back, i went to hospital in an ambulance after the incident and they said I might have been broken or severely cracked ribs.
The doors are supposed to be secure as part of health and safety, on some containers there's a rope or chain to keep them open or shut, but on a few of them there wasn't and when a strong wind blew it and hit me and this one had no safety measures to keep it open.
I didn't take a photos for picture evidence and i cant get there now, i don't no if the container will still be there anyway as its a haulage company, but the weather was pretty calm, the practice of the company with the containers was the reason for the accident, and the steel door slammed shut in the wind on my body.
I was struggling for money and to find work so got my self back on the yard/site, i then went back to the hospital because i couldn't breathe properly, they checked for liquid on my lungs but there wasn't any so I had X rays and MRI and it came back I had fractured the floaters, the bones at the bottom of my rib cage.
I am going to have to stay off work to help my recovery and avoid any more injuries, so I need to sue my employer to claim compensation for injuries and loss of earnings. can I claim compo and if so can I get a rough estimate of a no win no fee pay out?
