Work told me I can’t claim compensation if I take my holidays or SSP after an accident at work

I had an accident at work that was not my fault and was wondering if I could be entitled to compensation.

I was asked by work if I want to get holiday pay or get SSP from the government, but I was warned that If I wanted to make a claim I couldn’t if I chose to use up my remaining holiday for the days I’m off.

The doctor wants to sign me off for 4 weeks but I’m unsure what to do, I don’t know if it is worth claiming compensation, basically a few days ago I tripped over a piece of machinery on a work site, it shouldn’t have been left out were it could trip people over as a rule on site.

I fractured my knee and now I’m going to be out of work, how much compensation could I receive for an injury like this?

Would I lose my job with our firm if I claimed? I would rather take holiday pay and SSP then go back into work if I would only get £1-2000

I am sorry to hear of your accident, but I am happy to advise that you would be eligible to make a claim.

You are still entitled to make a claim even if you use holidays or receive SSP.

This would not affect your job as they are not legally allowed to treat you any different after making a claim.

We have to obtain what is known as a medico-legal report to support any claim for personal injury compensation. This is a straight forward process and we would take care of this and arrange the appointment for you. Once we have that report we would know how much your claim is likely to be worth. Generally speaking it depends on how long it takes you to recover. If, say, it took you around 12 months to make a recovery from the knee injury, you could receive around £12,000 upwards.
